A relevant Bill (Reg. No. 2120), introduced by the People´s Deputy, V. Moisyk, was Registered in The Verkhovna Rada of Ukraine.
The Sponsor refers to International practice to substantiate the need for adoption of this Law, stating that in many countries worldwide, private investigation businesses are recognized at a State level, are regulated by Laws, and are used optimally enabling citizens and legal entities to protect their lawful rights and interests. Private detective and investigation agencies provide considerable assistance to business entities that need to discover the reputation and financial standing of borrowers and other partners, or check their ability to fulfill their financial obligations, thus allowing them to avoid, wherever possible, the conclusion of risky contracts or situations whereby borrowers avoid repayment of their debts.
Furthermore, the Sponsor points out, Private Detectives/Investigators and Agencies are involved in tracing persons whose whereabouts are unknown, searching for missing property or animals, revealing the facts of intellectual property right infringements, primarily illegal use of trademarks, etc.
V. Moisyk notes that Private Investigators, as shown in the experiences gained by these countries, greatly improve the responsibility of the State Law Enforcement system for timely and highly skilled responses to the needs of citizens and society.
This type of activity is not officially recognised in Ukraine, and therefore has not been legally regulated, even if legal entities, and not only natural persons, are engaged in this activity.
The People´s Deputy stresses that the Bill, as introduced, will allow for the legalisation of these activities, bringing them out of the shadows, and putting them under reliable control by the State.
